FORECLOSURE TITLE SEARCH REPORTS
Our Foreclosure Search Reports are available in two distinct performance and characteristic levels:
Standard Search
This search provides the fundamental information needed by most foreclosing attorneys and may include some reference materials, copies and attachments for review.
Extensive Search
This search provides the most comprehensive information available from the public records and will include all reference materials, copies and attachments for review.
Pre-Foreclosure Search
A report showing the current owner of record to real estate and disclosing all liens, encumbrances and adverse claims affecting title to the real estate as found in the public records for the period of 30 years immediately preceding the date covered by the public records (“cover date”). The report would include:
a. LEGAL DESCRIPTION: a legal description of the property to be foreclosed (generally from a copy of the last deed of record or the mortgage that is being foreclosed);
b. CURRENT DEED: a copy of the last deed of record;
c. LIENS & ENCUMBRANCES: an abstract of any mortgage liens, judgments or other encumbrances creating a valid lien on the real estate to be foreclosed, including the address shown of record for the lienholder, as ascertained from the following searches, for the related period of time affecting the title of the mortgagor being foreclosed:

d. EXAMINATION OF TITLE: an examination of the chain of title from the last recorded deed of record to determine any adverse claims or matters of record affecting ownership since the mortgagor acquired title to the property that is being foreclosed.
A divorce search or estate search will NOT be included unless specifically requested by the client, for which an additional charge may apply.
This report does NOT include: deed restrictions, agreements, rights of way, easements, covenants and restrictions found during the period searched; any abstract or copies of the deed comprising the chain of title; or any examination of the chain of title to determine insurability, and will not include recommended title insurance requirements and exceptions to title.
Current Owner Pre-Foreclosure Search
A report showing the current owner or record to the real estate and disclosing all liens, encumbrances and adverse claims affecting title to the real estate as found in the public records since the current owner acquired title to the real estate. The search period would commence with the deed into the current owner of record and be completed through to the date covered by the public records (“cover date”). The report would include:
a. CURRENT DEED: a copy of the last deed of record;
b. LIENS & ENCUMBRANCES: an abstract of any mortgage liens, judgments or other encumbrances creating a valid lien on the real estate to be foreclosed, including the address shown of record for the lienholder, as ascertained from the following searches, for the related period of time of the ownership interest of the current owner only:

Continuation Search
This report “continues” the search completed for the Pre-Foreclosure Search Report or the Current Owner Pre-Foreclosure Search Report and will cover all similar matters found of record since the cover date of the previously issued report through to the new cover date of the public records. Multiple continuation searches may be requested until either the Sheriff’s Sale has been completed or the Foreclosure case is terminated.
Standard Exclusionary Option Discounts for the Extensive Foreclosure Search Report
Report without mortgage copies
• This report EXCLUDES providing copies of the open mortgages and notations found of record. Open mortgages of record and related notations are abstracted on the report.
Report without mortgage boilerplate pages
• This report EXCLUDES providing full copies of the open mortgages and notations found of record. Only the grant pages and signature pages of any open mortgages and related notations are provided with the report.
Report without chain of mortgage assignments
• This report EXCLUDES providing copies of intervening assignments to open mortgages. The chain of assignments are reviewed at the courthouse and the abstractor will note any discrepancies. Only the last assignment of record will be abstracted on the report and a copy provided.
Report without dockets
• This report EXCLUDES providing copies of dockets for any Mechanics Liens, Municipal Claims, Federal Liens, Judgments, or Bankruptcies that are disclosed on the report.
